Laura* was living in an Assisted Living Facility (ALF) that received her social security payment and payment from Medicaid to pay for her care at the facility. The ALF was over-billing Laura and a new management company filed a Chapter 83 action for tenant eviction against her. Laura and her children sought assistance from Legal Aid to avoid eviction from the ALF. A team of Legal Aid housing attorneys defeated the eviction on a motion to dismiss and in addition successfully argued for attorney’s fees.
