Jade* is an infant who has been helped by Legal Aid’s Permanency Project. The Permanency Project assists to achieve permanent placement for children with parents, relatives or other caregivers.
DCF removed Jade from her mother because they believed she could not care for her due to her physical disabilities. Her Legal Aid attorney filed a detailed motion to return Jade to the mother, arguing both Chapter 39, the ADA, and Florida Constitution. Supporting documentation was provided to prove that the mother’s disabilities were only physical and in no way limited her abilities to make healthy decisions for her infant. Additionally, the attorney was able to show that the mother has several adult family members who asset her with the physical needs of caring for her child.
Jade is now home with family because of our attorney’s advocacy. She is being well cared for by the family.
